The FFPSA has been identified, as some had anticipated, as a convoluted and inadequately drafted piece of legislation. It begins with a fundamental mislabeling. The Act refers to certain programs as “prevention services,” which include “in-home parent skill-based,” mental health, and drug treatment initiatives for parents who have already been determined to have abused or neglected their children. These programs are intended to prevent the need for foster care rather than to avert child abuse and neglect before they occur. Most experts would categorize these as “intervention” services rather than “prevention” services.
